Terms and Conditions of Bicycar Rental

BICYCLE RIDER’S ELIGIBILITY

You agree and acknowledge that:

  1. All bicycle riders require signature for the agreement document.
  2. You are over 18 years of age.
  3. You must show to the rental staff either passport or driver’s license (Australian or international driver’s license only).

Requirements

Identification

  • Passport or
  • Driver’s License (Australian or International one only)

Payment

At time of rental, please have your identification and cash with you. We require the rental cost plus $50/bike security bond. Security bond is held as a security through the rental period and returned in full if no further charges apply.

WHERE YOU CAN AND CANNOT RIDE THE BICYCLE

You must NOT take the bicycle to the following places:

  1. to outside Brisbane, Gold Coast and Sunshine Coast;
  2. on beaches or through streams, rivers, or flood waters;
  3. on flood prone roads or any roadway where the police or any other government authority has issued a warning or caution.

BICYCLE USE

You must NOT:

  1. allow or permit the bicycle to be used for any illegal purpose, race, contest or performance test of any kind;
  2. load to the bicycle more than 85kg total including your weight;
  3. load to the bicycle more than 3kg on the front basket if you have;
  4. sublet or let the bicycle on hire to any other person;
  5. be under the influence of alcohol, or drugs;
  6. use the bicycle when it is damaged or unsafe;
  7. operate or permit the bicycle to be operated in breach of any legislation, regulations, rules or by laws relating to road traffic and use;

MAINTENANCE, SECURITY AND SAFETY

You must:

  1. maintain bicycle in good and tidy conditions during rental period
  2. keep the bicycle locked whenever you are away from bicycle
  3. wear helmet and proper shoes whenever you ride the bicycle
  4. take correct procedure to fold and unfold the bicycle
  5. be aware folding bicycle is less stable than normal bicycle
  6. ride a bike on either bicycle road or footpath (for your safety)
  7. ride only flat paved road
  8. ride at the speed of no more than 14km/hr at any time
  9. check the bicycle’s frame, joint part, handle, brake, tire, pedal, and saddle etc before you ride

You must NOT:

  1. ride the bicycle at night time (ie. after 6pm-5am)
  2. ride the bicycle in rainy days (very slippery)
  3. ride the bicycle near busy car traffic (dangerous)
  4. leave the bicycle outside in rainy days
  5. ride the bicycle in off-road
  6. ride the bicycle in populated area (pull the bike instead)
  7. wear long sleeve clothes and pants which are easily tangles by chain
  8. modify the bicycle such as handle alignment, brake adjustment etc
  9. carry small luggage on hand or hang up on handle while you are riding bicycle
  10. arrage or undertake any repairs or salvage to the bicycle (whether because of accident or breakdown) without the express prior written authority of “Bicycar Rental” except to the extent that the repairs or salvage are necessary to prevent further damage to the bicycle or other property in which case you must first attempt to contact “Bicycar Rental” by phone to inform them of the steps you are intending to take and obtain approval to those steps.

BICYCLE RETURN AND REPLACEMENT

You must return the bicycle to Bicycar Rental staff directly.

  1. to the specified place, on the date & by the time shown on the booking mail
  2. in the same condition as it was at the commencement of Rental Period

If you return the bicycle to a location other than the specified shown on booking mail, a Drop Fee apply. If a Drop Fee applies, you must pay it at the end of the Rental Period.

Bicycar Rental reserves the right to not replace the bicycle if the bicycle is damaged before the rental period expires.

LOSS DAMAGE WAIVER, DAMAGE & LOSS OF PROPERTY

You are liable:

  1. for the loss of, and all damage to the bicycle
  2. the cost of repairing, and Drop Fee
  3. for all damage to your property or the property of any person which is caused or contributed to by you; or which arises for the use of the bicycle by you

Remember that references to the “bicycle” include all of its parts, components and accessories.

Loss damage waiver is subject to you and any authorized driver complying with the terms and conditions of the rental agreement.

You must always pay

  1. the damage liability fee if there is damage to or loss of the bicycle or if there is damage to the property of any third party;
  2. the cost of repairing any damage caused deliberately, carelessly or recklessly by You, or other people
  3. the cost of repairing any damage to the bicycle or to third party property by a breach of the rental agreement
  4. the cost of treatment pay if you harm someone.
  5. the full cost of replacing or repairing all contents supplied by Bicycar Rental.

OWNER’S LIABILITY

Except as provided at law, Bicycar Rental is not liable to any person, and you indemnify Bicycar Rental, for any loss of, or damage to, any property:

  1. Stolen the bicycle or otherwise lost or damaged during the rental

PAYMENT OF CHARGES

At the beginning of the Rental Period, you must pay Bicycar Rental on demand.

  1. all charges specified on booking mail and all charges payable under the Rental Agreement
  2. any penalty or fine incurred by you, the renter is liable to pay Bicycar Rental the infringement administration fee.
  3. any amount for which you are liable to Bicycar Rental under the rental agreement, in respect of a breach of the rental agreement or for damage or loss to the bicycle or third party property.

BREACH OF THESE TERMS AND CONDITIONS

Bicycar Rental shall have the right to terminate the rental agreement and take immediate possession of the bicycle at any time if you breach these terms and conditions.

Breaches of this rental agreement will result in You paying for:

  1. all costs to rectify the bicycle to its original condition or replacement of the bicycle; and/or
  2. loss of rental revenue to Bicycar Rental; and/or
  3. damage to third party property being your full responsibility; and/or
  4. injury to third party being your full responsibility; and/or
  5. all cost for us to pick up bicycle, storage and recovery of the bicycle.

PRIVACY POLICY

We at Bicycar Rental are committed to protecting and maintaining the privacy of your personal information. We will not disclose any customer’s personal information to any third party unless it is required legally.
